What is meant by independence of judiciary today in Pakistan?

Today, restoration of Chief Justice Iftikhar Chaudary means independence of judiciary in Pakistan. The lawyer’s community, the politicians and civil society believe that without reinstatement of CJ Iftikhar Chaudary, independence of judiciary would be meaning less. This kind of stance would further destabilize the situation in the country. Miscellaneous members of civil society consider the CJ issue the real issue. They are of the view that the establishment is striving to get rid of Chief justice since March 9th.

A leader of the lawyers’ community said, “How can the nation give up the right for independent judiciary in order to save a few individuals from accountability.” No doubt one being honest cannot consider minus one formula in best interest of the nation. In such circumstances the political party’s intentions would be translucent.

    Chief Justice of Pakistan, Mr Iftikhar Chowdhry. The beacon of hope, the torch bearer of freedom, the voice of the oppressed. The lawyer movement, one of the greatest civil movement Pakistan has seen since independence. Even the hanging of Mr ZA Bhutto or Coup against Mr Nawaz Sharif could not stir this storm, which the removal of Chief Justice caused in Pakistan.
    Or was this all just a drama, a fiasco to achieve aims absolutely other than the obvious. I am not trying to spew a conspiracy theory here. I just want to state some obvious facts for everyone to consider falling crazily in love with the whole idea of freedom of judiciary.
    The reason i fail to even believe in this entire saga of Mr CJ is the sheer outcome, the results that have come out in the light. Does it not arouse suspicion in your mind that right after the elections and change of regime, all the street mongering lawyers have calmed down as if there had never been an issue in this regard ever. The fiery speeches of Mr Kurd, the elaborate legal interpretations of Mr Aitezaz, have just vanished from the face of news, rather from the face of Pakistan.
    Read me through without being emotional, i am just asking common questions that should be answered, atleast so that i can stop brooding over this entire issue.
    The fact of the matter is that the entire scheme was a very well engineered and orchestrated game. A game played by none other than the political parties of pakistan, to achieve their nefarious aims, or to simple put it, to COME BACK INTO POWER.
    Why on earth did we fall victim to this crap in the first place. Lack of common sense. Did you people honestly ever believe that the reinstatement of the Chief Justice would mean revival of justice in our country. I feel like crying at the sheer innocence of your simple souls. Did you all honestly believe that just by bringing him back to his throne, the entire system of judiciary will fall back in order. That the session judges of Badin in Sindh will stop taking bribes to give pre-arranged decisions, that the high court in lahore will start giving decisions of cases in months rather in years. or the cliche’ ” if you want to win a case, why hire a lawyer, HIRE a Judge” will stop to exist. the Musharraf regime made a mistake, the mistake of removing him, they never thought this would even blow out of proportions like this, but in the other side of the fence, the major political forces in pakistan were waiting for him to commit just this sorta mistake so that they could work it into a revolutionary movement. What good is the revolutionary movement, if the outcome is NIL. I for one, always knew that this revolution is going to hit a solid wall of rock, the moment the regime change occurs. Not because i am genius who can see behind the curtains or read between the lines, but because i can see the very obvious, the very obvious others just somehow choose to ignore.
    The obvious being the this CJ is the very same man, who used to abuse lawyers and govt functionaries before this all happened and he turned into a saint. I am not making it up, this all is on record. The same chief justice never even once bothered to visit even a single bar council before his removal, but right after that he started practicing his legal right to visit and speak to all the bar councils in pakistan. The CJ never uttered a single political statement and let his puppets speak for him, despite his obvious disgust over the entire issue. The same CJ who legitimized every move of the Musharraf govt in parliment was suddenly a saint:D. When things turn to obvious weird, we choose not to pay attention thinking that these are too obvious things to be really true.
    The same Chief Justice even after being removed from the post was found saying to an Achakzai Minister in Quetta ” main to aaj bhi musharraf saab ka sipahi hoon, pata nahin kisnay merey khilaf unkay kaan bhar diye hain’.
    This is the CJ for you. And where is he now. Do you think that the lawyers are pacified now. That the chief justice is pacified now .. or for that matter mr Kurd and ahsan saahib …..
    nothing has changed, the only fact that has changed is that the MONEY….. which was being flooded in by the sharif borthers and the others have stopped coming in. That has changed everything. Everything. The poor lawyers from the local Kachehris, who were paid on daily basis to protest in favour of Mr CJ, are not being pain anymore, therefore they have no other choice but to go back to work. Musharraf’s govt tried to buy the judges so that they would take oath under PCO, but they were paid better at that point in time by the great DEMOCRATIC POLITICAL parties of Pakistan. Hence they stood their ground. But all that has changed. NO MONEY means now they made the best out of a situation and now have to make the best out of the situation at hand. The past demanded that they should call Mr CJ their father, their mentor and what and what not…. and the present demands … well demands that the CJ can go to hell and suck on an egg …. i have a living to make 😀
    Mr Sharif is playing his entire political game on the CJ issue. He helped create the hype, financed it fully with millions of ruppees. knowing fully well that the PPP people will ultimately will not be able to do anything about it. What a beautiful political game being played by Mr sharif here. Apparently he does not want anything but betterment for Pakistan, but deep down inside this game he is playing leads to nothing but another stint at being the premier of the country. He is intelligent enough not to get involved in the present turmoil pakistan faces, rather wants to sit on the side lines and see the PPP govt fail, who in the absence of Benazir and in the hands of the local DOGS of PPP are absolutely at a loss of what to do and making a mockery out of governance. All of sudden, all the oldies goldies of the CJ sagas a quiet and back in their chambers and it seems as if this was never an issue in the first place. Even the SO CALLED free MEDIA of Pakistan who again PAID very very heavily to play a vital role in this entire PLOT has forgotten. Not a minute
    went by in the past, when there was not a news of the CJ…. he has gone to the bathroom, he has wiped his A** with water or a tissue,,,….. but all i want to ask them now …. “itna sanata kyun hai bhai 😀 ????

    hmmm i am so tired of this all …. i just wanna sleep ….
