US Officials Claim Drone Attacks Are Legal And In Self Defense

Obama Drone AttackThere is an outcry by the people for a long time now concerning the continuous and dramatically increased drone attacks in the ungoverned tribal regions near the Afghan-Pakistan border. The Obama Administration has been criticized by human rights groups across the world for it. Some international law experts consider drone attacks to be illegal assassinations.

Pakistani officials have returned from America claiming that strategic partnership dialogs were triumphant but within a day the Obama administration has for the first time laid out its legal underlying principle for drone strikes. United States has justified the Central Investigation Agency (CIA) operated missile hits mentioning it as the right to “self-defense” under international law. During a conference of the American Society of International Law, State Department’s legal advisor Harold Koh argues that the missile hits were justified.

“The United States is in “an armed conflict” with Al-Qaeda, the Taliban and its affiliates as a result of the September 11 attacks, and may use force consistent with its inherent right to self-defense under the international law”.

In other words America has the legal right for killing innocent people with Drones wherever they have the doubt of Al Qaeda or Taliban presence because they are the enemy of America post 9/11. What about more than 1200 innocent Pakistanis assassination till now as a result of US justified drone attacks? Who is responsible for it? What will be the US opinion if Pakistan army starts to respond the drone attacks as a self defense?

The American Civil Liberties Union (ACLU) has recently filed a lawsuit against US President Barack Obama, demanding legal basis for America’s deadly drone attacks overseas. It is worth mentioning that many CIA officers might have to face prosecution for war crimes, due to the U.S. government’s refusal to offer legal grounds for the drone raids in Pakistan. International community was impatient with Washington ignoring the slur of the CIA’s bombing raids in Pakistan, Afghanistan and other parts of the world. In order to avoid the prosecution the US has come up with the justification.

Every country on the globe should respect each others soverngity. With power comes great responsibilties too but unfortunately not many are cpable to deal with it. It is high time for Pakistan and its government to learn to say NO.

    The shadow drones pact done between Pakistan and USA is a step in the right direction. Even though it is unarmed but it will help Pakistan target the insurgents hidden in the tribal areas of the country. We must appreciate the countries helping us fighting our war against militancy.

    @ Tayab, Every state is held responsible for the actions that occur within its boundaries, the loss of civilians in drone attacks is regretted and no amount of mine or your sympathy can aggravate the loss of the family, however the loss of civilian loss is exaggerated by the Taliban who cordon of the area and remove their bodies.
    @Hina Safdar, State Sovergnity is supreme but talking sense do we claim sovereignty over South Waziristan, we find it hard ourselves to maintain a writ of state in these areas. Hence if terrorist harbor in a region which is not under our control the question of sovereignty becomes irrelevant

    the effectiveness of DRONES is not the question WE WANT THEM BANNED & totally UN OPERATIONAL. Drones are an interference challenging the sovereignty of Pakistan.

    well the trbial areas have their own laws but they are part of Pakistan and Pakistani law is applicable on tribesman too. Not that much far to go to.

    The debate over the effectiveness of drone attacks is not new, and while in a fix of emotions we condemn them but we also fail to comprehend that in realist paradigm every state is liable for the actions of her subjects, we have failed to curtail the militants who are not only an internal but also a global threat. These drones have killed two commanders of Taliban i.e. Hakeemullah and Baitullah and numerous other militants so they have been effective in targeting high profile targets.

    Hina, I’m a bit puzzled about the status of the areas in question. Why are they not policed by Pakistan the same as the rest of Pakistan, like Islamabad and Karachi and the rest of the cities? Are they separate sovereignties, and if so, who is responsible for law and order in them? Are your remote areas so hard to get to, or just too unproductive to interest central government? After all, it’s been sixty-three years–maybe it’s those mountains–mountain people are reclusive everywhere–smaller horizons–but well, maybe you’re finally unifying the country?
    For your perspective, all the land areas of the US, from Florida to Alaska to Hawaii, operate under the same rules of federal law; anyone from anywhere in the US can go to any faraway part of it and know how to behave and who is in charge. Local ordinances differ only in trivial ways, and leadership anywhere here all use the same rule-book, very homogenized.

    It is a reflection of capabilities our government where interests lie in protecting their own position and safeguarding their necks. It is not only a total failure but also shameful. Earlier there were reports that these flights are from within pakistan!. It is not a coincidence that criminals are in high positions slaving this nation . A promoding nation where over 65% of population is between the age group of 18-25 years. The agenda is to demoralise them and keep them away from making progress.

    US legal advisers are no different from the Bin Laden’s one……..as both knw hw 2 play with words to bring their sins into the scale of morality……….
    its all baseless what this gentle men has said…….if they dam care for collateral demage…….dan why they cry that our civilianz are at risk…….coz the same logic implies for the terrorist who differentiate nothing between civilian and military
